By clicking “I Agree,” checking a related box, or otherwise affirmatively accepting these Terms and Conditions, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, you should not create an account or use the Service. You also authorize any party acting on your behalf who accepts these Terms to bind you to this Agreement.

Important Notice on Dispute Resolution: Unless you properly opt out, any disputes between you and us will be resolved through binding arbitration. You waive your right to a jury trial and to participate in class actions. Details are provided in the section below.

1. Company and Service Overview

OTG Consulting LLC DBA Oracle Capital (“we,” “our,” or “us”) owns and operates the website www.oracle-funding.com and any related applications or platforms (the “Platform”). The Platform provides access to financial products and service, and related digital tools (collectively, the “Service”).

Your use of the Service, including all content, products, and features, is subject to this Agreement.

2. Acceptance of Terms

By accessing or using the Service, you agree to comply with this Agreement and all applicable laws. If you do not agree, you may not access or use the Service. We reserve the right to modify these Terms at any time. Updates become effective when posted on the Platform. Continued use of the Service after changes are posted constitutes your acceptance of those changes.

3. Eligibility and Limited Use

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. Certain services may be available to users aged 13–17 years old, provided they have verified parental or guardian consent.

Use of the Service may be restricted based on your geographic location due to state-specific regulations.

4. Subscriptions

Some products and services are sold on a subscription basis. By enrolling in a subscription, you authorize recurring charges to your payment method until you cancel.

Renewals may be billed up to two (2) days prior to the scheduled renewal date for continuity.
You can cancel at any time via your online account or by contacting our customer support. Cancellations take effect at the end of the current billing cycle.
Refunds for partial subscription periods are not offered unless required by law.
We reserve the right to modify subscription pricing with prior notice.

5. Privacy

6. User Accounts and Security

You must create an account to use certain features. You are responsible for:

Maintaining accurate information,
Safeguarding your username and password,
Logging out after each session.

We are not responsible for unauthorized access to your account resulting from your failure to secure login credentials.

7. Prohibited Conduct

You may not use the Service to:

Engage in illegal, fraudulent, or harmful activities,
Attempt to gain unauthorized access to systems,
Upload harmful code or spam,
Misrepresent your identity,
Infringe on intellectual property rights.

Violations may result in account suspension or termination.

8. Payment and Terms of Sale

Prices are subject to change.
Applicable taxes and shipping charges will be displayed at checkout.
We accept valid payment methods only and reserve the right to cancel orders in cases of error or suspected fraud.
Title and risk of loss pass to you upon delivery to the carrier.

9. Intellectual Property

All content on the Platform is the property of OTG Consulting LLC DBA Oracle Capital or its licensors. You are granted a limited, revocable, non-transferable license to use the Service for personal purposes only.

10. Opt Out & Suport Mechanisms

You can cancel the SMS service at any time. Just text "STOP" to the [Phone Number]. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [email protected].

11. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

12. Message Frequency

As always, message and data rates may apply for any messages sent to you from us and to us from you. Messaging frequency varies based upon your service usage. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

13. SMS Messaging Terms & Compliance

1. Program Description: This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with OTG Consulting LLC DBA Oracle Capital through our website at https://oracle-funding.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.

2. Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

3. Support Information: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to OTG Consulting LLC DBA Oracle Capital or call 817-670-2562 during business hours.

4. Carrier Liability: Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.

6. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

7. Age Restriction: You must be 18 years or older to participate in our SMS program.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.

14. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” OTG Consulting LLC DBA Oracle Capital disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free access.

15. Limitation of Liability

To the fullest extent permitted by law, OTG Consulting LLC DBA Oracle Capital is not liable for indirect, incidental, consequential, or punitive damages. Our liability for direct damages shall not exceed $1,000.

16. Indemnification

You agree to indemnify and hold harmless OTG Consulting LLC DBA Oracle Capital and its Providers from any claims, damages, or expenses arising from your use of the Service or your violation of this Agreement.

17. Dispute Resolution & Arbitration

All disputes arising from this Agreement or your use of the Service will be resolved through binding arbitration in accordance with the rules of the National Arbitration & Mediation (NAM).

No class actions or representative claims are permitted.
Arbitration will be held in Texas, unless otherwise agreed.
You may opt out of arbitration within 30 days of first accepting these Terms by providing written notice.

18. Governing Law

This Agreement is governed by the laws of the State of Texas, without regard to conflict of law rules.

19. Termination

We may suspend or terminate your access to the Service at any time, without notice, for violations of these Terms or as otherwise required. Certain provisions (including disclaimers, limitations of liability, indemnification, and arbitration) will survive termination.

20. Entire Agreement

These Terms, along with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and OTG Consulting LLC DBA Oracle Capital regarding your use of the Service.
